1. Introduction

Welcome to Pickle Medtechnologies Pvt Ltd. (“Company,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access and use of our mobile application (“App”), website, and Software-as-a-Service (SaaS) portal (collectively, the “Platform”). By accessing or using our Platform, you (“User,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

Our Platform enables users—including patients, clinics, hospitals, healthcare professionals, and organizations—to store medical documents in the cloud, analyze reports using AI and related technologies, and access other healthcare-support features.

2. Eligibility

  • You must be at least 18 years old or the legal age of majority in your jurisdiction to use the Platform.

  • By using the Platform, you represent and warrant that you have the right, authority, and capacity to enter into these Terms.

  • If you are using the Platform on behalf of an organization, you confirm that you are authorized to bind that entity.

3. User Accounts & Security

  • To access certain features, you may be required to create an account.

  • You must provide accurate, current, and complete information during registration and keep your credentials secure.

  • You are responsible for all activities under your account.

  • Notify us immediately at [support email] of any unauthorized use or breach.

4. Services Overview

The Platform provides (but is not limited to) the following services:

  • Cloud-based medical document storage (e.g., prescriptions, lab reports, bills, scans).

  • AI-powered analysis of selected documents to generate summaries, patterns, and health insights.

  • Communication tools for clinics and patients to share or refer documents.

  • Access controls for users to manage sharing permissions with healthcare providers.

  • Integrations with other health platforms or APIs where authorized.

The Platform is not a medical device and does not replace professional medical advice. Always consult a qualified healthcare professional before making health-related decisions.

5. User Obligations

  • You agree not to upload, share, or transmit any content that is illegal, infringing, defamatory, obscene, or otherwise objectionable.

  • You are solely responsible for the accuracy and legality of all information and documents you upload.

  • You agree to use the Platform only for lawful purposes and in accordance with applicable data protection and healthcare regulations.

6. Data Storage and Retention

  • All documents are stored on secure cloud servers, with encryption in transit and at rest.

  • Storage is subject to usage limits based on your plan.

  • Data retention policies comply with legal retention periods and user preferences.

7. Subscription Plans & Payment

  • Certain services may require subscription or one-time payments.

  • Prices, billing cycles, and terms are outlined in your chosen plan.

  • All payments are processed securely through authorized gateways.​

8. Intellectual Property

  • All content, software, designs, logos, and trademarks are owned by Pickle MedTechnologies or licensed appropriately.

  • Users retain ownership of their uploaded documents but grant the Company a limited, revocable license to store, process, and analyze them solely for service provision.

  • You may not reverse engineer, decompile, copy, or redistribute the Platform without written consent.

9. AI & Analytics Disclaimers

  • AI analysis is intended to provide supportive insights only. It should not be relied upon as a substitute for clinical judgment or diagnosis.

  • The Company does not guarantee the accuracy, completeness, or fitness of AI-generated outputs.

  • Users are responsible for interpreting and using outputs responsibly.

10. Third-Party Integrations

  • The Platform may integrate with third-party services or APIs (e.g., labs, EHR systems).

  • The Company is not responsible for the availability, performance, or security of third-party services.

11. Termination

  • We may suspend or terminate accounts for violation of these Terms, legal obligations, or misuse.

  • Users may delete their account at any time through the Platform.

12. Limitation of Liability

  • To the maximum extent permitted by law, Pickle MedTechnologies Pvt Ltd is not liable for indirect, incidental, consequential, punitive, or exemplary damages.

  • Our total liability shall not exceed the amount paid by the user in the preceding 12 months, or ₹5,000 (whichever is lower).

13. Indemnification

You agree to indemnify and hold harmless the Company and its affiliates from any claims, damages, liabilities, or expenses arising from:

  • Your use of the Platform

  • Uploaded content

  • Violation of these Terms or applicable laws

14. Governing Law & Dispute Resolution

  • These Terms shall be governed by the laws of India, without regard to conflict of laws.

  • Any disputes shall be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka.

  • Arbitration may be opted for as per the Arbitration and Conciliation Act, 1996.

15. Modifications

We may update these Terms periodically. Continued use of the Platform after updates signifies acceptance of the revised Terms.
